Shoplifting may be charged as an infraction, misdemeanor, or felony, depending on what was stolen, the value of the merchandise, and whether the individual has any prior shoplifting convictions. Criminal charges can range from petty theft for property valued at less than $50 to felony grand theft for property valued at more than $950 or theft of a firearm.

The penalties for a shoplifting conviction may include:

  • Jail time of up to one year
  • Fines ranging from less than $250 to $1,000
  • Incarceration of up to three years for stealing a firearm

Depending on the situation and age of the shoplifter, there may be civil penalties in addition to criminal penalties. Shoplifters may be held civilly liable for the retail value of merchandise that cannot be sold and damages of between $50 and $500. This would be in addition to any fines imposed by the court for your criminal conviction.
